REPUBLIC ACT No. 4841

An Act Granting Pacific Associates Corporation a Franchise to Construct, Maintain and Operate an Ice Plant and Cold Storage and, and to Distribute and Sell Ice and Ice Flakes and/or Ice Tubes so Manufactured to Fishermen and Provide Cold Storage in Manila and Suburbs

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. Subject to the conditions imposed in this Act, there is granted to Pacific Associates Corporation, its successors or assigns, for a period of twenty-five years after the approval of this Act, the right, privilege and authority to construct, maintain and operate an ice plant and cold storage along the Pasig River in the City of Manila and the suburbs for the purpose of manufacturing ice and ice flakes and/or ice tubes for fishermen and the cold storage for the preservation of fish catch and others and so sell and distribute the ice and ice flakes and/or ice tubes so manufactured and render cold storage services and facilities and to charge and collect a schedule of rates and prices for the ice so manufactured, distributed and sold, which schedule of rates and prices shall at all times be subject to regulations by the Public Service Commission.

Section 2. The grantee shall install and maintain an ice plant and cold storage along the Pasig River within the City of Manila and the suburbs; Provided, However, That the ice plant shall manufacture ice for the use of fishermen.

Section 3. All the machinery equipment and appurtenances to be used by the grantee shall be modern, safe and first class in every respect.

Section 4. If the grantee shall not commence the project for the manufacture of ice within two years from the approval of this Act, unless prevented to by an act of God, or force majeure, martial law, riot, civil commotion, usurpation by a military power or any other cause beyond the grantee’s control, this franchise shall become null and void.

Section 5. This franchise is granted subject to the provisions of Commonwealth Act Numbered One hundred forty-six, as amended, only with respect to fixing rates, and with the understanding and upon the condition that it shall be subject to amendment, alteration or repeal by the Congress of the Philippines when public interest so requires.1avvphi1

Section 6. In the event that any competing individual, association of persons, or corporation receives from the Congress of the Philippines a similar franchise in which there shall be any term or terms more favorable than those herein granted or tending to place the herein grantee at any disadvantage, then such term or terms shall ipso facto become a part of the terms hereof and shall operate equally in favor of the grantee as in the case of said competing individual, association of persons or corporation.

Section 7. This Act shall take effect upon its approval.
