PRESIDENTIAL DECREE No. 1667 January 26, 1980

AMENDING SECTION 1 OF PRESIDENTIAL DECREE NO. 1661, AS AMENDED, ENTITLED: "PROHIBITING GUEST CANDIDACY AND PROVIDING SANCTIONS AND PENALTY THEREFOR"

WHEREAS, there are quite a number of cases for disqualification of candidates in the forthcoming local elections on January 30, 1980, that had reached the COMELEC and the courts of justice on the ground of violation of Article XII Section 190, of the Constitution which provides as follows:

"Sec. 10. No elective public officer may change his political party affiliation during his term of office, and no candidate for any elective public office may change his political party affiliation within six months immediately preceding or following an election."

WHEREAS, some of these cases depend upon the resolution of the issue concerning the party affiliation of the candidates involved in the controversy;

WHEREAS, it is presumed that all persons who participated in the campaign either as officers or as members of various political parties that fielded candidates in the 1978 elections for members of the Interim Batasang Pambansa were members of the parties for which they campaigned; and

WHEREAS, in said campaign for the April 1978 elections, the following political parties fielded candidates:

  1. BAGONG ANYO NG BUHAY PARTY (BANYUHAY)

  2. BAGONG LIPUNAN KILUSAN NG NAGKAKAISANG NACIONALISTA-LIBERAL

  3. BISOL-SARO

  4. CITIZENS UNION FOR PROGRESS

  5. CONCERNED CITIZENS AGGRUPATION

  6. CONFEDERATION OF ILOCANO ASSO., INC.

  7. CONSUMERS PARTY

  8. EMANCIPATED SCIENTISTS PARTY (ESP) OR SCIENTIFIC PARTY

  9. LAKAS NG BAYAN (LABAN)

  10. LAPIANG BAGONG SILANG

  11. MINDANAO ALLIANCE (PUNDOK MINDANAO)

  12. PARTIDO DEMOCRATA (ANG BAG-ONG KUSOG)

  13. PARTIDO NG BAGONG FILIPINO (PBF)

  14. PARTIDO SAMBAYANANG PILIPINO

  15. PHILIPPINE LABOR PARTY

  16. PUSY0N BISAYA (YOUNG TURKS)

  17. SOVEREIGN CITIZENS PARTY

  18. YOUNG PHILIPPINES PARTY

  19. YOUTH DEMOCRATIC MOVEMENT

  20. LIBERAL PARTY

    NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:

    Section 1. Section 1 of Presidential Decree No. 1661 as amended, is hereby further amended to read as follows:

    "Sec. 1. Guest Candidacy. It shall be unlawful for any registered or accredited political party to nominate and/or support as its official candidate any person belonging to another accredited or registered party unless he has affiliated with the nominating party unless he has affiliated with the nominating party at least six months before the election: Provided, that a person who participated as an officer in the campaign of a political party, group or aggrupation in the immediately preceding elections shall be deemed a member of such party as of the date of the political campaign, for purposes of nomination as official candidate of such party in succeeding elections."

    Section 2. This Decree shall take effect immediately.
