PRESIDENTIAL DECREE No. 738 July 1, 1975

AMENDING SECTION EIGHTY-FIVE, ARTICLE XIV, OF COMMONWEALTH ACT NO. FIVE-HUNDRED TWENTY, OTHERWISE KNOWN AS THE CHARTER OF THE CITY OF SAN PABLO

WHEREAS, there is a need to amend Section 85, Article XIV, of the Charter of the City of San Pablo, entitled "The Bureau of Education' for the following reasons:

1. There is no more Director of Education nor Bureau of Education;

2. San Pablo City has become a separate and ndependent division from the Division of Laguna since 1955;

3. Republic Act No. 5447, otherewise known as the Special Education Fund Act, already takes care of all specific rules and regulations including the creation, composition and functions of the City School Board;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:

Section 1. The subparagraphs of Section eighty-five of the Charter of the City of San Pablo are hereby amended to read as follows:

"Sec. 85. The Department of Education and Culture. The President of the Philippines shall appoint the City Superintendent of Schools. He may appoint persons already holding official positions.

"The Secretary of Education and Culture shall exercise the same jurisdiction and powers in the city, as elsewhere in the Philippines, and the city superintendent of schools shall have all the powers, jurisdiction and duties in respect to the schools of the city as are vested in division superintendents in respect to the school of their divisions.

"The City Council shall provide for additional compensation for the superintendent of city schools, so that the latter may have a total salary equal to that of a city department head of the same importance. The combined salaries received from the National Government and from the city by the city superintendent of schools shall be considered as his base pay."

Section 2. This decree shall take effect immediately.
