An Act Creating the Municipality of Banisilan in the Province of North Cotabato

Section 1. Subject to the approval of the majority of the votes cast in a plebiscite to be held in the areas affected, the barangays of Kalawang, Gastao, Paradise, Malinao, Camalig, Pinamulaan, Pantar, Busaon, Tinimbacan, Nalagap, Salama and Banisilan of the Municipality of Carmen, Province of North Cotabato, are hereby separated from said municipality and constituted into a distinct and independent municipality in the same province to be known as the Municipality of Banisilan, with its seat of government in the present site of Barangay Banisilan.

Section 2. The Municipality of Banisilan shall be bounded as follows:

"The point of origin is the intersection of Malitubog River and Cotabato-Lanao del Sur province boundary, point (1): thence following the Cotabato Lanao de Sur provincial boundary in an easterly direction to the junction of Kalawaeg and Maridagao Rivers, a common point boundary of Cotabato-Lanao del Sur and Bukidnon provinces, point (2); thence southerly following the Maridagao river downstream to its junction with Tumagak point (3), thence southwesterly in an imaginary straight line to the peak of Kitubod Range, point (4); thence continue in the same direction in an imaginary straight line to the center of Malitubog River, the common boundary of Carmen and Libungan municipalities, point (5); thence northerly following the upstream course of Malitubog River to its intersection with Cotabato Lanao del Sur provincial boundary, to point of origin."

Section 3. After the approval of the creation of such municipality in the plebiscite, the Mayor and members of the Sangguniang Bayan of the new Municipality of Banisilan shall be appointed by the President of the Philippines, or until hold office at the pleasure of the President, or until their successors shall have been elected in the next general elections for local officials, and shall have qualified.1avvphi1

Section 4. The Commission on Elections, shall conduct and supervise the plebiscite mentioned in Section one hereof, which shall be held within one hundred twenty (120) days from the approval of this Act. The expenses for the holding of such plebiscite shall be charged to local funds.

Section 5. This Act shall take effect upon its approval.
