[ Proclamation No. 262, September 23, 2002 ]

AMENDING PROCLAMATION NO. 396 DATED 31 MARCH 1989, RESERVING FOR HOUSING PROJECT PURPOSES, CERTAIN PARCEL OF THE LAND SITUATED IN RESIDENCE SECTION “D”, BAGUIO CITY AND DIRECTING THE NATIONAL HOUSING AUTHORITY TO DIRECTLY DISPOSE SAID PROPERTY TO ITS BONAFIDE OCCUPANTS

WHEREAS, in line with the priority concern of the present Administration to provide lands to deserving landless and homeless Filipinos that would ensure security of tenure of informal settler families occupying public lands which are not utilized for its intended purposes;

WHEREAS, Proclamation No. 396 reserved Lot No. 64, Residence Section “D”, Baguio Townsite, Baguio City with an approximate area of 8,981.99 square meters for the construction of a housing project exclusively to be leased and occupied by the employees of the Mansion House and/or their heirs;

WHEREAS, there is a need to modify the mode of utilization and disposition of the property from lease to direct sale to allow these families the chance to own the property which has become their home for 35 years;

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order as follows:

1. The National Housing Authority to effect the disposition of the subject property from lease contract to direct sale to the bona-fide occupants;

2. The creation of an inter-agency committee to be chaired by a representative of the HUDCC and composed of representatives from the PCUP, City Government of Baguio, and representative of the MHEHA that would be responsible in the determination of rationalized and cost recoverable payment scheme.
