AMENDING PROCLAMATION NO. 297 DATED DECEMBER 15, 1951 WHICH RESERVED CERTAIN PARCELS OF LAND OF THE PRIVATE DOMAIN OF THE GOVERNMENT LOCATED IN MA-A DAVAO CITY FOR RADIO STATION SITE PURPOSES UNDER THE ADMINISTRATION OF THE DIRECTOR OF TELECOMMUNICATIONS BY EXCLUDING CERTAIN PORTION OF THE LAND EMBRACED THEREIN AND DECLARING THE SAME OPEN FOR DISPOSITION IN FAVOR OF THE ACTUAL OCCUPANTS
Upon the recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby amend Proclamation No. 297 dated December 15, 1951 which reserved certain parcels of land of the private domain of the government located in Ma-a, Davao City for radio station site purposes under the administration of the Director of Telecommunications by excluding certain portion of the land embraced therein identified as Lot no. 14-B, Psd-11-067841 containing an area of Eighty Nine Thousand Eight Hundred Thirteen (89,813) square meters located in Ma-a, Davao City and declaring the same open for disposition in favor of the actual occupants in accordance with the provisions of Republic Act No. 477 dated June 9, 1950, as implemented by Joint Circular No. 1 dated September 30, 1989, of the Departments of Environment and Natural Resources, Public Works and Highways and Budget and Management; and retain the other portion identified as Lot No. 14-A, Psd-11-067841, containing an area of Twenty Seven Thousand Five Hundred Twenty (27,520) square meters, under the administration of the Telecommunications Office, subject to private rights, if any there be and whatever understanding that may hereto be agreed upon between the Department of Transportation and Communication and the City Government of Davao regarding the area being utilized by the Davao City Jail, which parcels of land are more particularly described as follows:

A parcel of land identified as Lot No. 14-A, Psd-11-067841, being a portion of Lot 14, Pcs-3144, situated at Barangay Ma-a, City of Davao, Province of Davao del Sur, Island of Mindanao. Bounded on the North along line 8-1 by Lot 11, Pcs-3144; on the East along lines 1-2-3-4-5-6 by Lot 14-B, Psd-11-067841; on the South along lines 6-7; and on the West along line 7-8, both by Road. Such part or parts of the area herein declared open for disposition, which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition.1aшphi1 Except in favor of the Government or any of its branches or agencies, all lands disposed of under this proclamation shall not be subject to alienation and encumbrance for a period of ten (10) years from the issuance of title, in case of sale, or execution of contract, in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of the said period; but the improvements on the land may be mortgaged to qualified persons, associations, partnerships or corporations.
An Inter-Agency Committee, composed of representatives of the Department of Environment and Natural Resources (DENR) as Chair, Housing and Urban Development Coordinating Council (HUDCC), Department of Transportation and Communication, Presidential Commission on the Urban Poor, City Government of Davao and concerned non-government or peoples organizations is hereby created to immediately implement this proclamation.
