ESTABLISHING THE DAPDAP RESETTLEMENT SITE FOR THE MOUNT PINATUBO VICTIMS IN THE MUNICIPALITY OF BAMBAN, PROVINCE OF TARLAC BY EXCLUDING A CERTAIN PORTION OF LAND FROM THE OPERATION OF PROCLAMATION NO. 163 DATED 03 APRIL 1993 WHICH ESTABLISHED THE CLARK SPECIAL ECONOMIC ZONE

WHEREAS, by operation of law, specifically Republic Act No. 7637 and Proclamation No. 1201, the existence of the Mt. Pinatubo Rehabilitation, Assistance and Development Commission, hereinafter referred to as the MPC expired on 31 December 2000;

WHEREAS, the national government has committed to continue the rehabilitation and development programs after the dissolution of the MPC through other appropriate government agencies; and

WHEREAS, Executive Order No. 6 dated 20 March 2001 directs the Housing and Urban Development Coordinating Council (HUDCC) to undertake and implement the remaining resettlement functions and responsibilities of the MPC upon its dissolution;

NOW, THEREFORE, in consideration of the urgent need to assist the families affected by the eruption of Mt. Pinatubo by providing them with suitable resettlement areas and livelihood opportunities conducive to their economic recovery and upon the recommendation of the Secretary of Environment and Natural Resources and by the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby establish the Dapdap Resettlement Site by excluding a certain portion of land from the operation of Proclamation No. 163 dated 03 April 1993 which established the Clark Special Economic Zone and declare the same open for disposition in favor of the Mt. Pinatubo victims, subject to private rights, if any there be, situated in the Municipality of Bamban, Province of Tarlac, Island of Luzon and more particularly described as follows:

“A parcel of land (as shown on plan Swo-41255, Psu-2724 (Port.) of Zone-D, Military Reservation), situated in the Municipality of Bamban, Province of Tarlac. Bounded on the SE., SW., and NW., along lines 1 to 83 by Portion of Zone D, Swo-41255, Psu-2724, Military Reservation; on the NE., and SE., along lines 83 to 90 by Portion of Zone F, Swo-41255, Psu-2724 Military Reservation; and on the SE; along lines 90 to 101-1 by Portion of Zone D, Swo-41255, Psu-2724, Military Reservation. Beginning at a point marked “I” on plan being S. 69 deg. 34W., 5582.42 m. from BLLM #1, Bamban Cadastre.

For purposes of formulating and adopting the implementing guidelines for the proper disposition of the said property, a Local Inter-Agency committee (LIAC) is hereby created. The Committee shall be chaired by the Housing and Urban Development Coordinating Council (HUDCC) thru its Pinatubo Project Management Office (PPMO), and co-chaired by the Bases Conversion Development Authority (BCDA), with the following agencies and organizations as members:

1. Department of Environment and Natural Resources

2. Bases Conversion Development Authority

3. Municipal Government of Bamban, Tarlac

4. Provincial Government of Tarlac

The LIAC shall invite the concerned Congressional Representative to participate in its activities to further expedite the disposition program herein set out.1aшphi1

The LIAC shall, among others, ensure that the actual metes and bounds of the said property are established through final survey, as necessary, and that the identification and qualification of beneficiaries, beneficiary guidelines, and a fair lot pricing and payment schemes are established and implemented.

The LIAC shall formulate a budget to implement this Order taking into account the funding requirements for the various activities (social preparation, census and tagging, ground survey, mobilization, etc.) that must be undertaken in connection herewith.

All previous issuances inconsistent with the provisions of this Proclamation shall be deemed revoked or amended accordingly.

This Proclamation shall take effect immediately.
