[ Proclamation No. 145, January 18, 2002 ]

DECLARING A CERTAIN PARCEL OF LAND KNOWN AS BATAAN SHIPYARD AND ENGINEERING COMPANY (“BASECO”) AREA SITUATED IN PORT AREA, CITY OF MANILA OPEN FOR DISPOSITION TO ITS ACTUAL OCCUPANTS IN ACCORDANCE WITH R.A. 730, IN RELATION TO THE PROVISIONS OF PUBLIC LAND ACT (C.A. NO. 141), AS AMENDED

Upon the recommendation of the Secretary of the Department of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL ARROYO, President of the Philippines, do hereby declare a certain parcel of land known as the “BASECO” area open for disposition to the actual occupants, in accordance with R.A. 730, in relation to the provisions of Public Land Act, Commonwealth Act No. 141, as amended, subject to private rights, if any there be, and to actual future survey. The specific portions herein reserved comprising an area of 520,000 square meters, more or less, are delimited as follows:

Bounded in the North by the Pasig river, in the South by South Harbor, in the West by Manila Bay and in the East by BASECO Compound (PCGG property).

The portion of the area herein declared open for disposition which is covered under the South Harbor Development Plan shall be excluded from such disposition.1aшphi1

The boundary of the subject area is subject to final survey.

Such part or parts of the area herein declared open for disposition which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition except in favor of the government or any of its branches or agencies. All lands disposed of under this proclamation shall not be subject to alienation and encumbrances for a term of ten (100 years from the issuance of the title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the improvements on the land may be mortgaged to qualified persons, associations or corporations.
