REVOKING PROCLAMATION No. 427, DATED DECEMBER 7, 1953, PROCLAMATION No. 473, DATED DECEMBER 28, 1953, AND PROCLAMATION No. 478, DATED DECEMBER 29, 1953, RESERVING FOR CHILD WELFARE PURPOSES, FOR THE AGED AND INFIRM, FOR HOME PURPOSES, AND FOR REHABILITATION CENTER PURPOSES, RESPECTIVELY, CERTAIN PARCELS OF THE PRIVATE DOMAIN OF THE GOVERNMENT, SITUATED IN THE DISTRICT OF CUBAO, CITY OF QUEZON, AND DECLARING THE SAME OPEN FOR DISPOSITION FOR THE BONAFIDE RESIDENTS OF BARANGAYS ESCOPA I, II, III, IV, UNDER THE PROVISIONS OF REPUBLIC ACT No. 3038 IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT (COMMONWEALTH ACT No. 141, AS AMENDED)

Upon the recommendation of the Secretary of the Department of Environment and Natural Resources and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby revoke Proclamation No. 427 dated December 7, 1953, Proclamation No. 473, December 28, 1953, and Proclamation No. 478, dated December 29, 1953 reserving for Child Welfare purposes, for The Aged and Infirm, for Home purposes, and Rehabilitation Center purposes, respectively, certain parcels of land embraced therein, situated in the District of Cubao, City of Quezon, and declaring the same open for disposition under the provisions of the Act No. 3038, in relation to the provisions of Commonwealth Act No. 141, as amended, and Republic Act No. 730 under the administration of the Department of Environment and Natural Resources, subject to private rights, if any there be, and to final survey, if necessary.

Such part or parts of the area herein declared open to disposition which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition. Except in favor of the Government or any of its branches or agencies, all land disposed of under this proclamation shall not be subject to alienation and encumbrance for a term of ten (10) years from the issuance of title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the improvements on the land may be mortgaged to qualified persons, associations or corporations.1aшphi1

No alienation, transfer or conveyance of any land covered by this proclamation within the period of ten (10) years and before twenty five (25) years after issuance of title shall be valid without the approval of the Secretary of the Department of Environment and Natural Resources through the recommendation of the Regional Executive Director, DENR-NCR, which approval shall not be denied except on constitutional and legal grounds.
