AMENDING PROCLAMATION NO. 455, SERIES OF 1994, BY RESERVING FOR RESETTLEMENT AND LIVELIHOOD PURPOSES OF THE NATIONAL AMNESTY COMMISSIONS POST-AMNESTY PROGRAM, A PARCEL OF LAND SITUATED IN THE MUNICIPALITIES OF MABINI, DASOL, AND INFANTA, PROVINCE OF PANGASINAN, ISLAND OF LUZON

Upon recommendation of the Secretary of Environment and Natural Resources and pursuant to the authority vested in me by law, I, JOSEPH EJERCITO ESTRADA, President of the Republic of the Philippines, do hereby amend Proclamation No. 455, series of 1994, by reserving for the purpose of establishing a resettlement and livelihood community under the administration and disposition of the National Amnesty Commissions Post-Amnesty Program mainly for its amnestied rebel returnees, a parcel of land situated in the Municipalities of Mabini, Dasol and Infanta, all of the Province of Pangasinan, Island of Luzon, subject to existing rights and dispositions, if any, which reserve is more particularly described as follows, to wit:

“A parcel of land situated in the municipalities of Mabini, Dasol and Infanta, Province of Pangasinan, Island of Luzon. containing an area of FORTY FOUR MILLION NINE HUNDRED SEVENTY NINE THOUSAND SEVEN HUNDRED SIXTY NINE (44,979,769) square meters, subject to further surveys, and further subject to earlier dispositions made by the DAR of about TWELVE MILLION SIX HUNDRED THIRTY FOUR THOUSAND TWO HUNDRED FORTY FOUR (12,634,244) square meters, leaving a net area of THIRTY TWO MILLION THREE HUNDRED FORTY FIVE THOUSAND FIVE HUNDRED TWENTY FIVE (32,345,525) square meters.

The technical description above is subject to adjustments based on the result of a final survey.1aшphi1

All areas within the reservation that fall within the classification of agricultural, timberland, pasture land, forest land or mineral public land, if any, and which are under the administration of the Department of Environment and Natural Resources, shall be allocated and reserved for the administration and disposition under the National Amnesty Commissions Post Amnesty Assistance Program, in accordance with the above-described technical descriptions and/or the final survey as duly approved, in a manner consistent with existing laws and regulations.

The Department of Environment and Natural Resources shall retain jurisdiction over portions covered by pending Public Land applications filed prior to Proclamation No. 455, series of 1994, and shall continue to process such applications. All vested rights and dispositions already made inside the reservation shall likewise be respected.

Furthermore, the reservation covered by this Proclamation and the eventual award for final disposition to qualified beneficiaries shall be subject to established ancestral claims over portions of the area duly investigated, confirmed, and registered with the appropriate government agencies therefor.

That the initial sum of TWENTY MILLION PESOS (P20M) is hereby authorized to be appropriated out of any funds in the National Treasury, not otherwise appropriated, to be released by the Office through the Department of Budget and Management, as authorized by this Proclamation. Also the National Amnesty Commission is hereby allowed to include in its annual budget the amount of TEN MILLION PESOS (P10M), for use in the continuing development and operation of this project.

Finally, the National Amnesty Commission is hereby authorized to call on all agencies of the government for coordinative assistance and shall be required to extend personnel, machinery, technical and technological support as may be determined necessary to bring into full effect the purposes of this Proclamation.
