[ Proclamation No. 385, September 8, 2000 ]

DECLARING A LAND OWNED BY THE GOVERNMENT (BUREAU OF ANIMAL INDUSTRY) LOCATED IN THE CITY OF VALENZUELA OPEN TO DISPOSITION AS THE SITE OF THE DEPARTMENT OF AGRICULTURE HOUSING PROJECT

WHEREAS, the Government recognizes that shelter is a basic requirement for which low income families, particularly public servants, require assistance;

WHEREAS, a tract of land with an area of sixty thousand square meters (60,000) located in Valenzuela (now Valenzuela City), was acquired by the Bureau of Animal Industry, a staff bureau of Department of Agriculture;

WHEREAS, the entire area of the said land has not been operationally utilized by the Bureau of Animal Industry or the Department of Agriculture;

WHEREAS, the disposition of the entire area for use as a housing project for the personnel of the Department of Agriculture, its offices, bureaus, agencies and attached corporations will not in any manner adversely affect the operational requirements of the Bureau of Animal Industry or the Department of Agriculture;

WHEREAS, Book III, Title 1, Section 14 of Executive Order No. 292, otherwise known as the “Administrative Code of 1987”, provides:

“The President shall have the power to reserve for settlement or public use, and for specific public purposes, any of the lands of the public domain, the use of which is not otherwise directed by law. The reserved land shall thereafter remain subject to the specific public purpose indicated until otherwise provided by law or proclamation;”

“He shall also have the power to reserve from sale or other disposition and for specific public uses or purposes, any land belonging to the private domain of the Government, or any of the Friar Lands, the use of which is not otherwise directed by law, and thereafter such land shall be used for the purposes specified by such proclamation until otherwise provided by law.”

NOW, THEREFORE, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, do hereby declare (1) the conversion to patrimonial property of the lot owned by the Bureau of Animal Industry covered by the Transfer Certificate Title No. 21806 of the Register of Deeds for Valenzuela City, said portion not being utilized by the Bureau of Animal Industry, consisting of sixty thousand (60,000) square meters, more or less, and more particularly described hereunder; and (2) its disposition as the site of the Department of Agriculture housing project;

A Parcel of Land (Lot 986-A, Fls-2588, being a portion of Lot 986 Malinta Estate, LRC Rec. No. 5941), situated in Torres Bugallon (now Brgy. Marulas), Mun. of Valenzuela (now Valenzuela City), Island of Luzon. Bounded on the NE., along line 2-3-4-5-6-7-8 by Lot 989, Malinta Estate, road 3.0 meters wide and Lot 987 Malinta Estate; on the SE., along 8-9 by Lot 987, Malinta Estate; on the SW., along line 9-10-11-12-13 by Lot 987, Malinta Estate and Lot 985-C, Fls-453-D and barangay road; along line 1-2 by Lot 986-B, Fls-2588 (now barangay road).

Beginning at a point marked “1” on plan, being S.79-47W.,

903.2 meters from Monument 23, Malinta Estate;

thence N.57-20E., 276.52 m. to point 2;

S.2-08E., 29.93 m. to point 3;

N.59.17E. 16.10 m. to point 4;

S.31-42E., 79.90 m. to point 5;

S.21-48E., 2.70 m. to point 6;

N.75-19E., 8.70 m. to point 7;

S.1-56E., 101.00 m. to point 8;

S.57-51 ‘W., 17.40 m. to point 9;

S.64-32W., 137.20 m. to point 10;

N.33-33W., 43.40 m. to point 11;

N.8-33E., 85.30 m. to point 12;

N.17-21E., 1.70 m. to point 13;

N.18-02W., 73.30 m. to point of beginning, containing an area of SIXTY THOUSAND (60,000) SQUARE METERS, more or less. All points referred to are indicated on the plan and are marked on the ground by B.L. PS. cyl., conc. mons. except points 9, 11, and 12 by GI Spike; bearings true; date of original survey, April 20, 1906 – June 30, 1907 (Malinta Estate) and that of the relocation survey on March 7, 1956 by virtue of the Director of Lands.

The portion or portions of the areas herein declared open to disposition as are presently used or earmarked for public or quasi-public purposes shall be excluded from such disposition, except in favor of the Government or any of its branches or agencies. All land disposed of under this Proclamation shall not be subject to alienation for a term of ten (10) years from the issuance of the title, in case of sale, or execution of the contract, in case of lease, nor shall they become liable for the satisfaction of any debt contracted prior to the expiration of the said period; but that the same, together with the improvements thereon, may be mortgaged.

The housing project referred to herein shall be administered by the Department of Agriculture and, for this purpose, the National Housing Authority and other government instrumentalities involved in the Housing Program of the Government shall provide assistance in the disposition of homelots to qualified officials and employees of the Department of Agriculture and its offices, bureaus, agencies and attached corporations.1aшphi1
