DECLARING FIFTY (50) HECTARES OF THE SIXTY (60) HECTARES OF THE TALA ESTATE RESERVED FOR THE LEPROSARIUM AND SETTLEMENT SITE OF THE HANSENITES AND THEIR FAMILIES UNDER PROCLAMATION NO. 843 AS AMENDED AS ALIENABLE AND DISPOSABLE AND CONVERTING THEM INTO HOUSING SITES

WHEREAS, mass housing has been declared as the centerpiece program of the Administration in line with its “Erap Para sa Mahirap” vision, pursuant to Executive Order No. 159 dated 12 October 1999;

WHEREAS, in accordance with this policy, the government has made the provision of housing and housing assistance to the underprivileged and homeless a priority concern;

WHEREAS, there is an urgent need to provide permanent housing for the bona fide residents, hansenites and their immediate families, personnel of the Department of Health, and other qualified occupants of the 808-hectare Tala Estate owned by the government;

WHEREAS, the current residents have petitioned the government to allocate an additional portion of the Tala Estate leprosarium and resettlement site for housing purposes;

WHEREAS, the leprosarium can continue to operate effectively on less land than it currently occupies;

WHEREAS, it is in the public interest and in line with government policy that a larger portion of the Tala Estate be devoted to housing;

NOW, THEREFORE, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, by virtue of the powers vested in me by law, do hereby declare as follows:

1. Fifty (50) of the sixty (60) hectares reserved for the leprosarium and resettlement site of hansenites and their families under Proclamation No. 843 as amended are hereby declared as alienable and disposable for use as housing site for the benefit of bona fide residents, hansenites and their immediate families, employees of the Department of Health (DOH), and other qualified occupants.

2. The National Housing Authority (NHA) in coordination with the DOH, is hereby designated as the agency primarily responsible for the identification of the specific parcels of land covered by this Proclamation and the distribution of these parcels to the designated beneficiaries. The NHA is hereby empowered to issue any guidelines necessary to effect this identification and distribution.

3. An Ad Hoc Committee chaired by a representative from the NHA and composed of representatives from the DOH, the Presidential Commission for the Urban Poor, the City Government of Caloocan, a peoples organization of the Tala Estate residents, and a non-government organization involved with the urban poor, chosen according to the guidelines issued by the NHA, is hereby created to conduct the identification of beneficiaries.

4. Proclamation No. 843 as amended, insofar as it is inconsistent with this Proclamation, is hereby amended or modified accordingly.1aшphi1
