DECLARING THE MALAMPAYA SOUND, SITUATED IN THE MUNICIPALITIES OF TAYTAY AND SAN VICENTE, PROVINCE OF PALAWAN, AS A PROTECTED AREA PURSUANT TO REPUBLIC ACT 7586 (NIPAS ACT OF 1992) AND SHALL BE KNOWN AS MALAMPAYA SOUND PROTECTED LANDSCAPE AND SEASCAPE

Upon recommendation of the Secretary of Environment and Natural Resources, and pursuant to the powers vested upon me by law, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, do hereby set aside and declare Malampaya Sound consisting of parcels of land and marine waters situated in the Municipalities of Taytay and San Vicente, Province of Palawan, as protected area under the category of Protected Landscape and Seascape, subject to private rights and without prejudice to the rights of the indigenous peoples as provided for in R.A. No. 8371, DENR Administrative Order No. 2, Series of 1993 and other related rules and regulations.1aшphi1

The Malampaya Sound Protected Landscape and Seascape shall have the following descriptions, to wit:

Point of beginning containing an area of TWO HUNDRED THOUSAND AND ONE HUNDRED FIFTEEN HECTARES (200,115 hectares) more or less, subject to actual ground survey.

The Malampaya Sound Protected Landscape and Seascape shall be under the administrative jurisdiction of the Department of Environment and Natural Resources (DENR) and shall be administered in accordance with the provisions of the NIPAS Act of 1992 and its implementing rules and regulations.

The DENR shall prioritize the implementation of the General Management Plan Strategy (GMPS) for Malampaya Sound which shall include the protection and conservation strategies as well as the promotion of sustainable use of resources. The DENR, through its corporate arm, the Natural Resources Development Corporation (NRDC) shall plan and implement joint venture agreement with the private sector, local government units and the communities for purposes of sustainable coastal and marine resource development and the promotion of the area as an ecological destination. The DENR shall work out the necessary institutional arrangements the soonest possible time and promulgate rules and regulations towards this end, particularly in establishing the different management zones in the protected area and the generation of funds to be used in biodiversity conservation and in maintaining and improving the resource base of the area.

The Protected Area Management Board (PAMB) appointed by the DENR Secretary, shall perform such powers and duties as specified in the NIPAS Act and as delegated to it by the Secretary under such Act.
