EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 265 DATED 31 MARCH 1938 ENTITLED “RESERVING FOR THE USE OF THE PHILIPPINE ARMY THREE PARCELS OF PUBLIC DOMAIN SITUATED IN THE BARRIOS (NOW CALLED BARANGAY) OF BULUA AND CARMEN, MUNICIPALITY OF CAGAYAN (NOW CALLED CAGAYAN DE ORO CITY), PROVINCE OF MISAMIS ORIENTAL, ISLAND OF MINDANAO.” A CERTAIN PORTION OF THE LAND EMBRACED THEREIN AND DECLARE THE SAME NO LONGER NECESSARY FOR PUBLIC USE OR SERVICE AND ARE OPEN FOR ALIENATION AND DISPOSITION FOR THE AFP OFF-BASE HOUSING PROGRAM TO BE DISPOSED OF UNDER THE PROVISIONS OF REPUBLIC ACTS NOS. 274 AND 730

Upon the recommendation of the Secretary of the Department of Environment and Natural Resources and pursuant to the authority vested in me, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, do hereby exclude from the operation of Proclamation No. 265 entitled “Reserving for use of the Philippine Army three parcels of public domain situated in (now called Barangay) of Bulua and Carmen, Municipality of Cagayan (now called Cagayan de Oro City), Province of Misamis Oriental, Island of Mindanao,” a certain portion of the land embraced therein and declare the same no longer necessary for public use or service and are open for alienation and disposition for the AFP Off-Base Housing Program, subject to private rights, if there be any, and actual survey, to be disposed of under the provisions of Republic Acts Nos. 274 and 730 in relation to the provisions of Public Land Act, which portions are more particularly described as follows:

LOT NO. (4318) ? Beginning at a point marked 1. On Bureau of Lands plan Swo ? 15234, N. 40 deg. 59" W., 1,103.72 m. more or less from B.L.L.M. No. 18. Cagayan Cadastre No. 237,

Thence N. 40 deg. 31" E., 204.32 m. to point 2;
Thence S. 84 deg. 31" E., 137.52 m. to point 3;
Thence S. 52 deg. 19" E., 218.45 m. to point 4;
Thence S. 07 deg. 22" E., 649.63 m. to point 5;
Thence N. 76 deg. 58" W., 322.82 m. to point 6;
Thence N. 35 deg. 42" W., 406.24 m. to point 7;
Thence N. 12 deg. 08" W., 71.53 m. to point 8;
Thence N. 14 deg. 02" E., 167.98 m. to point 1

point of beginning containing an area of THREE HUNDRED THOUSAND THREE POINT FIFTY SIX (300,003.56) square meters, more or less. All corners are B.L. concrete monuments (old). Bounded on the:

North, by Lots Nos. 4311 and 4312;

Northeast, by Lot No. 4311;

East and Southeast, by Lot No. 4354;

South, by Lot No. 4305;

Southwest, by Lots Nos. 4304 and 4317; and

Northwest, by Lots Nos. 4317, 4315 and 4311.

Except in favor of the Government any of its branches or agencies, all lands disposed of under this proclamation shall not be subject to alienation and encumbrance for a term of ten (10) years from the issuance of title in case of sale or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period, but the improvements on the land may be mortgaged to qualified persons, associations or corporations.1aшphi1

No alienation, transfer or conveyance of any land covered by this proclamation after ten (10) years and before twenty-five (25) years after issuance of title shall be valid without the approval of the Secretary of Environment and Natural Resources, which approval shall not be denied except on constitutional and legal grounds.
