PROCLAIMING AND DECLARING AN AREA IN HILL 118 IN URBIZTONDO, SAN JUAN, LA UNION, AS A MILITARY RESERVATION FOR THE RELOCATION OF THE PHILIPPINE AIR FORCE FROM THEIR 30 HECTARE RETENTION AREA IN PORO POINT, SAN FERNANDO, LA UNION AND TRANSFERRING SAID 30 HECTARE RETENTION AREA TO THE BASES CONVERSION DEVELOPMENT AUTHORITY THEREBY AMENDING PROCLAMATION 216, AS AMENDED BY PROCLAMATION 270

WHEREAS, Proclamation No. 216 (27 July 1993), as amended by Proclamation 270 (05 October 1993), excluded 30 hectares from the Poro Point Special Economic and Freeport Zone and from the transfer to the Bases Conversion Development Authority;

WHEREAS, said 30-hectare area was retained with the Philippine Air Force to be reserved for the radar and communication station of the Philippine Air Force (PAF);

WHEREAS, said 30-hectare area, as part of the Wallace Air Station, is found to be vital and crucial to the development of a commercial and tourism estate in the Poro Point Special Economic and Freeport Zone;

WHEREAS, the area in Hill 118 in Barangay Urbiztondo in San Juan in the province of La Union was found to be, among the areas surveyed, most suitable as an alternative location for the PAF radio and communication station currently located in Poro Point, San Fernando in the province of La Union;

NOW, THEREFORE, pursuant to the powers vested in me by law, I, JOSEPH EJERCITO ESTRADA, do hereby proclaim, declare and designate, subject to private rights, if any there be, the following:

1. an area in Hill 118, Barangay Urbiztondo in San Juan in the province of La Union as a military reservation for the Philippine Air Force (PAF) as the “PAF Relocation Site” for the PAF radar and communication or “watch station” unit stationed in and to be relocated from Poro Point in San Fernando in the province of La Union; and

2. the 30-hectare area, part of Wallace Air Station in Poro Point, San Fernando in the province of La Union, reserved for and retained by PAF for its radar and communication station to be transferred to the Bases Conversion Development Authority and made part of the Poro Point Special Economic and Freeport Zone.1aшphi1

The PAF Relocation Site in Hill 118 shall cover forty (40) hectares, more or less, subject to actual survey, which portion is more particularly described as follows:

“A parcel of land (within an area portion of L.C. Map No. 2862, Project 17 BLOCK-D), situated in Urbiztondo, Municipality of San Juan, Province of La Union. Bounded on the N., along points 3 & 4 by the proposed DENR Housing Lot; on the E., along points 4, 5, 6 & 7 by alienable and disposable land, L.C. Map No. 2862, Project 17; on the S., along points 8 & 1 (which is along the municipal boundary of San Fernando and San Juan) by Timber Land, L.C. Map No. 2862, Project 17; and on the W., along points 1, 2 & 3 by alienable and disposable land, L.C. Map No. 2862, Project 17. Beginning at a point marked “1” on the plan, being N., 61 deg. 26" E., 686.27 M. from MBM No. 3, Cad 539-D (being MBM No. 19, Cad. 739-D and BBM No. 5, Cad 739-D), which is also the point marked “8”;

thence N 21 deg. 00" E 74.38 M. to point 2
thence N 04 deg 05" E 237.94 M. to point 3
thence S 86 deg. 30" E 666.66 M. to point 4
thence S 30 deg. 00" E 161.19 M. to point 5
thence S 28 deg. 00" E 380.00 M. to point 6
thence S 29 deg. 00" W 141.02 M. to point 7
thence N 89 deg. 01" W 243.70 M. to point 8
thence N 61 deg. 26" W 686.27 M. to point of

beginning, containing an area of FOUR HUNDRED THOUSAND SQUARE METERS (400,000 sq. m.) more or less.

Due to its elevation appropriate for efficient communication and its suitability for construction of vertical structures, the PAF Relocation Site shall be for the exclusive use of the Philippine Air Force for military and other purposes directly related to and supportive of PAF operations in the area.

Any provision of law to the contrary notwithstanding, the classification of subject PAF Relocation Site shall hereby be converted from timberland to land reserved for military purposes.

No alienation, transfer or conveyance of any land covered by the area in Hill 118 proclaimed as a military reservation shall be made within ten (10) years, nor after twenty-five (25) years from issuance of title upon approval of the Secretary of Environment and Natural Resources, which approval shall not be denied except on constitutional and legal grounds.

IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
