RESERVING FOR RESEARCH, EXTENSION, INSTRUCTION PURPOSES, FOREST REHABILITATION AND PROTECTION, BIO-DIVERSITY CONSERVATION, CROPS AND LIVESTOCK PRODUCTION AND MANAGEMENT INCLUDING, UPLAND COMMUNITIES TRAINING AND DEVELOPMENT CENTER OF THE UNIVERSITY OF THE PHILIPPINES, A CERTAIN PARCEL OF LAND OF THE PUBLIC DOMAIN SITUATED IN BARANGAY KIDAWA, MUNICIPALITY OF LAAK, DAVAO DEL NORTE

Upon recommendation of the Secretary of Environment and Natural Resources pursuant to Section 18 of Presidential Decree No. 705, otherwise known as the Revised Forestry Code of the Philippines, as amended, and by virtue of the powers vested in me by law, I, FIDEL V. RAMOS, President of the Republic of the Philippines, do hereby withdraw from sale, entry disposition or settlement and reserve for research, extension and instruction purposes, forest rehabilitation and protection, bio-diversity conservation, crops and livestock production and management including, upland communities training and development center of the University of the Philippines Mindanao Reservations, subject to future survey and private rights, if any there be, a certain parcel of land of the public domain situated in Barangay Kidawa, Municipality of Laak, Davao del Norte, more particularly described as follows:

LAAK, DAVAO DEL NORTE

Bounded on the North by Project No. 56-B, timberland, per LC Map 1856 dated May 10, 1955; Bounded on the East by Project No. 56-B Timberland per LC Map 1856 dated May 10, 1955 and Project No. 20-J Timberland, Block-B, per LC Map 1894 dated August 30, 1955; Bounded on the South by Project 20-J Block B, Timberland per LC Map 1894 dated August 30, 1955; Bounded on the West by Alienable or Disposable Project No. 20-J & 56-B per LC Map 1894 and 1856 dated August 30, 1955 and May 10, 1955, respectively.

Beginning from BLLM No. 10, PLS-456, Saug, Davao del Norte, N. 18° 03" E., 8,378.94 m. to point “1”, thence:

Following Forest Zone line corners 27-22 of Project No. 56-B, Alienable or Disposable per L.C. Map-1856 dated May 10, 1955 from points 2 to point 6;

Due North 640.00 meters to point 7;
Due East 3,700.00 meters to point 8;
S. 07° 24" W. 6,796.52 meters to point 9;
S. 79° 19" W. 4,477.60 meters to point 10

Following Forest Zone lines corners 28-1 of Project No. 20-J, Block 11, Alienable or Disposable per L.C. Map-1894, dated August 30, 1955 from point 11 to point of

beginning, containing an area of TWO THOUSAND EIGHT HUNDRED (2,800) HECTARES, more or less.

The technical description and the area covered by this proclamation are subject to change upon the conduct of final survey. The University of the Philippines Mindanao shall undertake a final survey, demarcation and monumentation of the reservation under the direct supervision of the Lands Management and Forest Management Services of DENR-Region XI.

The administration and management of the area covered by this reservation shall be under the supervision of the University of Philippines Mindanao, Region XI, Davao City. Such supervision shall be in coordination with the appropriate CENROs and PENROs where the area is situated and the Forest Management Services of the Department of Environment and Natural Resources, Region XI.

For this purpose, the University of the Philippines Mindanao shall submit to the Office of the President of the Philippines a five-year development plan within one (1) year from the date of approval hereof. Copies of said development plan shall be furnished the Department of Environment and Natural Resources, Region XI and DENR Secretary.

A thorough inventory and ground validation of all tenurial instruments and/or rights and a validation survey of all the Indigenous Peoples (IPs) residing in the area shall be done by DENR-Region XI, in close coordination with the University of the Philippines Mindanao. There shall be judicious and prompt turnover of the list of all tenurial instruments and/or rights and all other DENR projects within the reservation.

Provided, that a Memorandum of Agreement shall be executed between the Department of Environment and Natural Resources and the University of the Philippines Mindanao with respect to the manner of management, delineation of duties and responsibilities and approaches in the involvement of the communities and the Indigenous Peoples (IPs) in the development of projects consistent with the Memorandum of Understanding between the University of the Philippines Mindanao and the Kidawa Cultural Communities.

Provided, that no forest occupant, individual or entity shall be dislodged or deprived of his priority rights over the area without fair and just compensation in accordance with the CARP Law. All Indigenous Peoples (IPs) located inside the reservation, shall not in any way waive or transfer their claims/rights to the land.

Provided, that all beneficiaries of existing tenurial rights/claims located inside the reservation, prior to the Proclamation, shall be respected and accommodated for their long-term security and stability.1aшphi1

Provided further, that when the area is no longer needed for the purpose stated and its development has already been abandoned, withdrawn or cancelled, the subject areas are automatically reverted to its original status as integral part of the forestlands.

A twenty-hectare portion of the area reserved herein shall be dedicated to a Training and Experimental Station of the Department of Environment and Natural Resources.
