EXEMPTING CERTAIN PORTIONS OF PUBLIC LAND IN ALABANG, MUNTINLUPA CITY, FROM SALE OR OTHER DISPOSITION UNDER COMMONWEALTH ACT 1120 AND RESERVING THE SAME AS SITE FOR CIVIC CENTER, PUBLIC MARKET, AND CITY PUBLIC HIGH SCHOOL UNDER THE CONTROL AND ADMINISTRATION OF THE MUNTINLUPA CITY GOVERNMENT

WHEREAS, Section 7 of Article X of the 1987 Constitution provides that local government units shall be entitled to an equitable share in the proceeds of the utilization and development of the national wealth within their respective areas, in the manner provided by law including sharing the same with the inhabitants by way of direct benefits;

WHEREAS, Section 2 of the 1991 Local Government Code (R.A. No. 7160) provides that it is the declared policy of the state that the territorial and political subdivisions of the state shall enjoy genuine and meaningful local autonomy to enable them to obtain their fullest development as communities and make them more effective partners in the attainment of national goals;

WHEREAS, the National Government owns a 244-hectare property located in Alabang, Muntinlupa City, covered by Transfer Certificate of Title No. 185552 issued by the Registry of Deeds for Makati, Metro Manila and identified as Lot 39 of the Muntinlupa Estates under the provisions of Act No. 120 as amended;

WHEREAS, under Section 14, Chapter 4, Title I, Book III and Section 50, Chapter 12, Book I respectively of the 1987 Administrative Code of the Philippines, the President has the power to reserve from sale or any disposition and for specific public uses or purposes any of the Friar Lands, the use of which is not otherwise directed by law, and the authority to transfer for official use real property belonging to the National Government to any local government unit;

WHEREAS, under Section 289 of Local Government Code of 1991 (RA No. 7160), local government units are entitled to have an equitable share in the proceeds derived from the utilization and development of the national wealth within their respective areas, including sharing the same with the inhabitants by way of direct benefits;

WHEREAS, under the Muntinlupa Estate Master Development Plan, an aggregate area of 9.6103 hectares had been reserved for public purpose and use, such as sites for civic center, hospital, public market, public plaza and public high school for the use under the control and administration of the City of Muntinlupa;

NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Republic of the Philippines, by virtue of the authority vested in me by law, and upon recommendation of the Secretary of the Department of Environment and Natural Resources, do hereby declare certain portions of Lot 392 of the Muntinlupa Estates, with an aggregate area of 9.6103 hectares, more or less, as exempt from sale or other disposition under Act No. 1120, as amended, and hereby reserve the same as sites for civic center, public market, public high school and city government center, under the control and administration of the Muntinlupa City Government which portions are hereunder particularly described as follows, to wit:

Title to and ownership of, the area covered by this proclamation shall be conveyed to the City of Muntinlupa; Provided that the lots covered by the herein proclamation shall not be alienated, transferred, or conveyed to any persons or entities, neither shall the same be encumbered nor be the subject of any transaction, contract or agreement which may lead to the change or diminution of ownership of the reserved properties; and Provided, further that in the event the same lots shall cease to be utilized for purposes herein mentioned, the same shall automatically revert back to the ownership of the national government.
