RESERVING FOR PUBLIC AND QUASI-PUBLIC PURPOSES AND FOR URBAN DEVELOPMENT UNDER THE ADMINISTRATION AND MANAGEMENT OF THE CITY GOVERNMENT OF GENERAL SANTOS CERTAIN TRACTS OF LAND OF THE PUBLIC DOMAIN LOCATED IN BARANGAY TAMBLER, GENERAL SANTOS CITY, ISLAND OF MINDANAO

Upon recommendation of the Secretary of the Department of Environment and Natural Resources, and pursuant to the provisions of Section 14, Chapter IV, Title I, Book III, of Executive Order No. 292, Series of 1987, instituting the Administrative Code of 1987, in relation to the provisions of Section 83 of Commonwealth Act No. 141, otherwise known as the Public Lands Act, as amended, and by the virtue of the powers vested in me by law I, FIDEL V. RAMOS, President of the Republic of the Philippines, do hereby reserve for public and quasi-public purposes and urban development, under the administration and management of the City Government of General Santos, a certain tract of land of the public domain containing an area of Four Hundred Twenty Six Hectares, more or less, which are more particularly described as follows:

A parcel of land situated in Barangay Tambler, City of General Santos City, Province of South Cotabato, Island of Mindanao;

Bounded on the North-East by Lot 3, Mr-11-000022; on the South-East by PLA 3290; on the South by BIU Creek; on the West by FLGLA 346; on the North by Presidential Proclamation 446 and Lot 1, Mr-11-000022.

Beginning at a point “1” on the plan identical to corner 1, alienable and disposable being S. 42º 23" W., 5,051.30 m. from BLBM No. 1, Makar, thence:

The development and utilization of the reserved area shall be strictly in accordance with the urban development for public and quasi-public purposes contained in the Master Development Plan of the area to be submitted by the government of General Santos City for approval of the President of the Philippines and upon the recommendation of the Secretary of the Department of Environment and Natural Resources; subject however to the provisions of environmental and natural resources laws, rules and regulations and such other related laws.

The utilization of the reserved land shall not, in any way, prejudice the ecological balance in the area, and the removal of timber and other forest products therein shall be subject to forest and internal revenue laws and regulations.

The jurisdiction over the area insofar as the enforcement of environmental and natural resources laws, rules and regulations and such other related laws, and the final disposition of the same, if ever allowed by law, shall remain with the Secretary of the Department of Environment and Natural Resources.

The final survey and delineation on the ground of the reserved area shall be undertaken by the DENR at the expense of the government of General Santos City.
