AMENDING PROCLAMATION NO. 297, DATED JULY 21, 1938, BY RESERVING AND DESIGNATION CERTAIN PORTION OF THE LAND EMBRACED THEREIN AS THE COTABATO PROVINCIAL FOREST AND ECOTOURISM PARK FOR THE BENEFIT AND ENJOYMENT OF THE PEOPLE OF THE PHILIPPINES

Upon recommendation of the Secretary of Environment and Natural Resources and the request of the Provincial Government of Cotabato in representation of the Associates Rural Development, Inc., and by virtue of the powers vested upon me by law, I, FIDEL V. RAMOS, President of the Republic of the Philippines, do hereby amend Proclamation No. 297, dated July 21, 1938, which established the Kidapawan Lanzon Forest Reserve (FR 80), converted into Amas Reforestation Project pursuant to Reforestation Administration Order No. 3, dated 12 April 1966, located in Barangay Amas, Municipality of Kidapawan, Province of Cotabato, by reserving and designating certain portion of the land embraced therein as the Cotabato Provincial Forest and Ecotourism Park for forest and ecotourism park purposes for the benefit and enjoyment of the people of the Philippines and withdraw from sale, lease, settlement, or other disposition, subject to private rights, if any there be, and to the implementation of other forestry and ecotourism development programs consistent with the objective of this Proclamation, which parcel of land is more particularly described as follows:

The area covered by this Proclamation is subject to change as a result of the final survey and delineation on the ground to be undertaken by the Department of Environment and National Resources with the support and assistance from the Provincial Government of North Cotabato.

The said parcel of land shall be known as the “Cotabato Provincial Forest and Ecotourism Park” to be managed through LGU-driven interagency, multisectoral and participatory schemes, subject to the general executive supervision and control of the Secretary of Environment and Natural Resources.

No cutting of trees within the Cotabato Provincial Forest and Ecotourism Park shall be allowed without the expressed approval of the Department of Environment and Natural Resources.

The introduction of any developmental projects within the area will be subject to the Environmental Impact Assessment System.

No portion whatsoever covered by the Provincial Forest and Ecotourism Park shall be leased or redeveloped without the mutual consent of the DENR and the Provincial Government of North Cotabato.

The DENR Seed Proclamation Area, and other ongoing and future DENR scientific researches shall be maintained. In addition, a botanical garden within the Forest and Ecotourism Park shall be established.

A management plan covering the Forest and Ecotourism park shall be developed by the Provincial Government of Cotabato, Cotabato Provincial PNP Command and the concerned people organizations and NGOs with the assistance of the Department of Environment and Natural Resources.
