AMENDING PROCLAMATION NO. 287, DATED APRIL 18, 1956, WHICH RESERVED FOR HOSPITAL SITE PURPOSES OF THE ARMED FORCES OF THE PHILIPPINES (AFP) A CERTAIN PARCEL OF LAND OF THE PRIVATE DOMAIN OF THE GOVERNMENT SITUATED IN THE CITY OF CEBU, ISLAND OF CEBU, BY EXCLUDING A PORTION FROM THE LAND EMBRACED THEREIN AND DECLARING THE SAME OPEN FOR DISPOSITION TO ACTUAL OCCUPANTS THEREOF UNDER THE PROVISIONS OF THE PUBLIC LAND ACT, AS AMENDED

Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, FIDEL V. RAMOS, President of the Philippines, do hereby amend Proclamation No. 287, dated April 18, 1956, which reserved for hospital site purposes of the Armed Forces of the Philippines (AFP) a certain parcel of land of the private domain situated in the City of Cebu, Island of Cebu, by excluding a portion from the land embraced therein and declaring the same open for disposition to actual occupants thereof under the provisions of the Public Land Act, as amended, which portion is more particularly described as follows:

A PARCEL OF LAND (Lot 2, Pcs-072217-002643, being a portion of Lots 645-A and 645-B, Pls-1541-D of Banilad Friar Land Estate) situated in the City of Cebu, Island of Cebu. Bounded on the SE., along line 1-2 by Lot 1, Pcs-072217-002643; on the SW., along lines 2-3-4-5 by Lot 646, Banilad Estate; on the NW., along line 5-6 by Lot 648, Banilad Estate and on the NE., along line 6-1 by Lot 1528, Banilad Estate. Beginning at a point marked “1” on plan, being N. 01-59 W., 752.34 m. from Monument 1, Banilad Friar Land Estate.1aшphi1

point of beginning, containing an area of FOURTEEN THOUSAND THREE HUNDRED FOURTEEN (14,314) SQUARE METERS, more or less. All points referred to are indicated on the plan and are marked on the ground, as follows: points 1 and 2 by P.S. Cyl. Conc. Mons. 15 x 10 cms. and the rest by Old P.L.S. Cyl. Conc. Mons. 15 x 60 cms. Bearings true, date of original survey, July 1906 and August, 1907 and that of the subdivision survey executed on February 16, 1993 by Geodetic Engineer Patricia N. Lim.

Except in favor of the Government or any of its branches, units, or institutions, or legally constituted banking corporations, lands acquired under this Proclamation shall not be subject to encumbrance or alienation from the date of approval of the application and for a term of five years from and after the date of issuance of the patent or grant, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period, but the improvements or crops on the land may be mortgaged or pledged to qualified persons, associations, or corporations. “No alienation, transfer, or conveyance of any homestead after five years and before twenty-five years after issuance of title shall be valid without the approval of the Secretary of Agriculture and Commerce (Department of Environment and Natural Resources), which approval shall not be denied except on Constitutional and legal grounds.” (Section 118, Public Land Act)
