MALACAÑAN PALACE MANILA BY THE PRESIDENT OF THE PHILIPPINES [ Proclamation No. 853, January 30, 1992 ] EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 59 DATED 9, MAY 1936, WHICH RESERVED THE MT. APO NATIONAL PARK SITUATED IN THE PROVINCES OF COTABATO AND DAVAO, A CERTAIN PORTION OF THE LAND EMBRACED THEREIN AND DECLARING THE SAME AS A GEOTHERMAL RESERVATION WHEREAS, the State may directly or through its instrumentalities undertake or cause the undertaking of the exploration, development and utilization of geothermal energy; WHEREAS, geothermal energy is one of the countrys principal sources of energy; WHEREAS, the interest of the State requires that certain areas within the Mt. Apo National Park be reserved as a geothermal reservation; NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of Proclamation No. 59 dated 9 May 1936 creating the Mt. Apo National Park situated in the Provinces of Cotabato and Davao certain portions of the land embraced therein and reserve the same as a geothermal reservation under the administration of the Philippine National Oil Company (PNOC) for the purpose of developing, exploiting and utilizing geothermal energy, subject to private rights, if any there be, as shown and plotted on the attached Board of Technical Surveys and Maps Plan of the Municipality of Kidapawan, North Cotabato, Sheet 404 111, which is more particularly described, as follows: A PARCEL OF LAND situated within the Mt. Apo National Park, Municipality of Kidapawan, Province of Cotabato, beginning at point marked “1” on plan being S 80 deg 11" W and 10,547.26 m from a 1953 BCGS monument APO BL-29E, thence S 52 deg 12" E and 4,274.96 m to point “2”, thence S 37 deg 8" W and 1,640.11 m to point “3”, thence N 52 deg 12" W and 4,274.96 m to point “4”, thence N 37 deg 48" E and 1,640.01 m to point of beginning; containing an area of seven million ten thousand square meters (7,010,000.00 sq. m.), more or less.1aшphi1 IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
