[ Proclamation No. 39, September 9, 1992 ]

RESERVING CERTAIN PARCELS OF LAND OF THE PUBLIC DOMAIN SITUATED IN THE DISTRICT OF TONDO, CITY OF MANILA, FOR HOUSING AND RELATED COMMERCIAL/INDUSTRIAL DEVELOPMENT

WHEREAS, pursuant to Presidential Decree No. 757, dated July 31, 1975, the National Housing Authority is mandated to undertake the physical and socio-economic upgrading and development of lands of the public domain identified for housing;

WHEREAS, Memorandum Order No. 415, dated January 17, 1992, directed the National Housing Authority to implement the Smokey Mountain Development Plan and undertake the reclamation of the area across Road Radial 10;

WHEREAS, Memorandum Order No. 161-A, dated March 2, 1988, mandated the National Housing Authority to conduct feasibility studies and develop a low-cost housing project at the dumpsite, better known as the Smokey Mountain of Metro Manila;

WHEREAS, the National Housing Authority has presented a viable conceptual plan to convert the Smokey Mountain dumpsite into a habitable housing project, inclusive of the reclamation of the area across Road Radial 10 (R-10) adjacent to the Smokey Mountain as the enabling component of the project;

WHEREAS, the National Housing Authority had caused the preparation of the boundary survey plan of said parcel of public land (reclaimed area), the survey returns of which shall be submitted to the Lands Management Bureau, Department of Environment and Natural Resources;

NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby reserve for a housing project and related commercial/industrial development, certain parcels of land situated in the District of Tondo, City of Manila, subject to private rights, if any there be, which parcels of lands are more particularly and tentatively describe as follows:

TECHNICAL DESCRIPTION
SMOKEY MOUNTAIN

A parcel of land ( ) situated in the District of Tondo, City of Manila, Island of Luzon.

Bounded on the North, by Marala River; on the East, by the property of B and I Realty Co., Inc. (Lot 1-B, PSD-11923); on the South, by the property of the Republic of the Philippines (SWD-40963) and Vitas River; and on the West; By Road Radial 10 xx-xx-xx-xx-xx, containing an area of Two Hundred Twelve Thousand to Hundred Thirty Four (212, 234) square meters, more or less, all points referred to are indicated on the plan and are marked on the ground, bearings true, date of survey, January 24 to February 2, 1992.

RECLAMATION AREA

A parcel of land ( ) situated in the District of Tondo, City of Manila, Island of Luzon.

Bounded on the North by Manila Bay; on the East by Radial 10 Road; and on the South and West, by Manila Bay xx-xx-xx-xx-xx, containing an area of Four Hundred Thousand (400,000) square meters, more or less.

These parcels of land of public domain are hereby placed under the administration and disposition of the National Housing Authority to develop, subdivide and dispose to qualified beneficiaries, as well as its development for mix land use (commercial/industrial) to provide employment opportunities to on-site families and additional areas for port-related activities.

In order to facilitate the early development of the area for disposition, the Department of Environment and Natural Resources, through the Lands Management Bureau, is hereby directed to approve the boundary and subdivision survey and to issue a special patent and title in the name of the National Housing Authority, subject to final survey and private rights, if any there be.1aшphi1

This Proclamation shall take effect immediately.
