EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 237, DATED DECEMBER 19, 1955, WHICH ESTABLISHED THE MILITARY RESERVATION KNOWN AS FORT MAGSAYSAY, SITUATED IN THE MUNICIPALITIES OF PAPAYA (NOW. GEN. TINIO), STA. ROSA AND LAUR, PROVINCE OF NUEVA ECIJA AND PORTION OF QUEZON PROVINCE, ISLAND OF LUZON, PHILIPPINES, CERTAIN PORTIONS OF THE LAND EMBRACED THEREIN KNOWN AS BARANGAY MILITAR AND DECLARING THE SAME OPEN TO DISPOSITION UNDER THE PROVISIONS OF REPUBLIC ACT NO. 730 IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT AS AMENDED.

Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, CORAZON C. AQUINO, President of the Philippines, do hereby exclude from the operation of Proclamation No. 237, dated December 19, 1955, which established the Military Reservation known as Fort Magsaysay situated in the Municipalities of Papaya (Now Gen. Tinio), Sta. Rosa and Laur, Province of Nueva Ecija and portion of Quezon Province, certain portions of the land embraced therein known as Barangay Militar and declare the same open to disposition in accordance with Republic Act No. 274 in relation to Act No. 3038 and the pertinent provisions of Republic Act No. 730 regarding direct sale in relation to the provisions of the Public Land Act as amended, which portion is particularly described as follows:

A parcel of land, Lot 2532, Cad. 269, Sta. Rosa Cadastre, situated in Barangay Militar (formerly Barangay Mapalad, Municipality of Sta. Rosa) City of Palayan, Province of Nueva Ecija, Island of Luzon, Philippines; Bounded on the E., and NE., by Lot 2526, Sta. Any provision of law to the contrary notwithstanding, disposition of lots under this Proclamation covering any titled portion of the reservation shall be exempted from the usual publication and open public bidding requirements pursuant to Act 3038 and shall be disposed of in the manner and under the conditions prescribed under Republic Act No. 730, subject to private rights if there be any.

Such part of the area herein declared open to disposition under Republic Act No. 730 in relation to the provisions of the Public Land Act which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition. Except in favor of the government or any of its branches and agencies, all lands disposed under this Proclamation shall not be subject to alienation or incumbrance for a term of ten (10) years from the issuance of title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period except for housing loan purposes, but the improvements on the land may be mortgaged to qualified persons, associations or corporations.

The land may be alienated, transferred or conveyed after ten (10) years but before twenty five (25) years after issuance of the title and upon approval of the Secretary of Environment and Natural Resources, through the Regional Executive Director, which approval shall not be denied except on constitutional or legal grounds.
