[ Memorandum Circular No. 10, January 27, 1966 ]

ENJOINING OFFICIALS AND EMPLOYEES OF THE GOVERNMENT FROM ISSUING PRESS RELEASES REGARDING MATTERS UNDER INVESTIGATION.

WHEREAS, it has been observed that certain heads and personnel of some offices, agencies and instrumentalities of the government have been issuing press releases concerning matters under investigation pertaining to their respective offices in justification, clarification or otherwise of the matters being; looked into before termination of the investigation, resulting in a trial by publicity; and

WHEREAS, such unrestrained publicity has not only caused confusion in the public mind as to the true facts of the case but has even proved detrimental to a proper and objective investigation, which are inimical to the public interest;

WHEREFORE, all officials and employees of the different departments, bureaus, offices, agencies and instrumentalities of the government, including government-owned or controlled corporations, are hereby enjoined from issuing press releases regarding matters under investigation pertaining to their resistive offices, even if they are in possession of the alleged facts, before the termination of the investigation and approval of the investigation report and recommendation by the Office of the President, without first clearing such press releases with the Office of the President.1âшphi1

Any official or employee violating this order, directly or indirectly, shall be subject to disciplinary action, including removal from office depending on the gravity of the offense, after due investigation.
