[ EXECUTIVE ORDER NO. 86, July 25, 2019 ]

AMENDING EXECUTIVE ORDER NO. 24 (S. 2017), ENTITLED "REORGANIZING THE CABINET CLUSTERS SYSTEM BY INTEGRATING GOOD GOVERNANCE AND ANTI-CORRUPTION IN THE POLICY FRAMEWORKS OF ALL THE CLUSTERS AND CREATING THE INFRASTRUCTURE CLUSTER AND PARTICIPATORY GOVERNANCE CLUSTER"

WHEREAS, Executive Order (EO) No. 24 (s. 2017) created the Infrastructure Cluster to focus on infrastructure development for the realization of the 10-Point Socio- Economic Agenda of the National Government and to enhance, among others, the delivery of public infrastructure by ensuring efficient and transparent management of assets and resources, focusing both on management of assets and the shift to service-oriented approaches that enable stakeholders to become co-producers of services;

WHEREAS, pursuant to Republic Act (RA) No. 7227 or the "Bases Conversion and Development Act of 1992," as amended, the Bases Conversion and Development Authority (BCDA) was tasked, among others, to adopt, prepare and implement a comprehensive and detailed development plan for the conversion of the Clark and Subic Military reservations into other productive uses to promote economic and social development;

WHEREAS, the mandate of the BCDA in the conversion of the Clark and Subic military reservations and their extensions into alternative productive uses, its vital public infrastructure projects such as tollway, railway, airport, seaport, and new economic growth corridor, and its role in the "Build, Build, Build" program, warrant its inclusion as a Member of the Infrastructure Cluster,

WHEREAS, pursuant to Section 17 of RA No. 7227, as amended, the BCDA shall be under the direct control and supervision of the Office of the President for purposes of policy direction and coordination; and

WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all executive departments, bureaus and offices, as well as the mandate to ensure the faithful execution of laws;

NOW, THEREFORE, I, RODRIGO ROA DUTERTE, President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Amendment to EO No. 24. Paragraph 3, Section 3 of EO No. 24 is hereby amended to read as follows:

"The composition of the Cluster shall be as follows:

Chair: Secretary, Department of Public Works and Highways

Members:

The Executive Secretary

The Cabinet Secretary

Head, Presidential Management Staff

Secretary, Department of the Interior and Local Government

Secretary, Department of Budget and Management

Secretary, National Economic and Development Authority

Secretary, Department of Transportation

Secretary, Department of Finance

Secretary, Department of Information and Communications Technology

Secretary, Department of Trade and Industry

Secretary, Department of Agriculture

Secretary, Department of Health

Secretary, Department of Social Welfare and Development

Secretary, Department of Education Secretary,

Department of Tourism

President, Bases Conversion and Development Authority

Secretariat: National Economic and Development Authority"

Section 2. Unaffected provisions. Except as expressly modified by this Order, all other provisions of EO No. 24 shall remain in full force and effect.

Section 3. Repeal. All other issuances, orders, rules and regulations or parts thereof inconsistent with the provisions of this Order are hereby repealed or modified accordingly.ℒαwρhi৷

Section 4. Separability. If any provision of this Executive Order is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

Section 5. Effectivity. This Order shall take effect immediately upon its publication in the Official Gazette or a newspaper of general circulation.
