RESOLUTION No. 3642

AMENDING COMELEC RESOLUTION NO. 3619 DATED 13 FEBRUARY 2001 INSOFAR AS THE NUMBER AND ALLOCATION OF MEMBERS, HOUSE OF REPRESENTATIVES AND ELECTIVE MEMBERS OF THE SANGGUNIANG PANLALAWIGAN OF ZAMBOANGA DEL SUR AND FIXING THE NUMBER AND ALLOCATION OF CONGRESSMEN AND SANGGUNIANG PANLALAWIGAN OF THE NEWLY CREATED PROVINCE ZAMBOANGA SIBUGAY

WHEREAS, Republic Act No. 8973 created the province of Zamboanga Sibugay out of the province of Zamboanga del Sur;

WHEREAS, the creation of Zamboanga Sibugay was ratified in a plebiscite held on 22 February 2001;

WHEREAS, Section 7 of said Act provides that the present 3rd Congressional District of Zamboanga del Sur shall constitute the Lone Congressional District of Zamboanga Sibugay while Zamboanga del Sur shall retain the 1st and 2nd Congressional District;

WHEREAS, Section 4 of Republic Act No. 6636 provides that the number of elective members of the Sangguniang Panlalawigan shall be based on the income classification of the province, that is, 1st and 2nd class provinces shall each have ten (10) elective Sangguniang Panlalawigan members; 3rd and 4th class provinces shall each have eight (8); and 5th and 6th class provinces shall each have six (6);

WHEREAS, Section 3 of Republic Act No. 7166 provides that the number of elective Sangguniang Panlalawigan members in provinces comprising:

a) two or more legislative districts shall be apportioned equitably by legislative districts and elected also by districts; that if equal division is not possible, the remaining member or members is/are to be elected in the district or districts with the greater number of population or if they be the same, with the greater number of voters; that if a legislative district includes a city that does not vote for provincial officials, the number of seats shall be allocated among the districts in proportion to the population of the constituencies voting for the Sangguniang Panlalawigan.

b) one legislative district shall be equitably apportioned between the two (2) provincial districts established by the Commission.

WHEREAS, the Bureau of Local Government Finance informed the Commission that the newly created province of Zamboanga Sibugay has been tentatively classified as 2nd class; while the province of Zamboanga del Sur remained as 1st class;

NOW, THEREFORE; considering the above and by virtue of the powers vested in it by the Constitution, the Omnibus Election Code, Republic Acts No. 6636, 7166 and other election laws, the Commission RESOLVED as it hereby RESOLVES to fix the number and allocation of seats of Members, House of Representatives and elective members of the Sangguniang Panlalawigan in the provinces of Zamboanga del Sur and Zamboanga Sibugay, as follows:

Let the Education and Information Department of the Commission publish this Resolution in two (2) daily newspapers of general circulation in the Philippines, and to furnish copies thereof to the Regional Election Director of Region IX, the Provincial Election Supervisors and Election Officers of Zamboanga del Sur and Zamboanga Sibugay.
