RESOLUTION No. 3503

IN THE MATTER OF THE PROPOSED AMENDMENT OF SEC. 6, COMELEC RESOLUTION NO. 3420

This pertains to the Memorandum dated 16 January 2001 of Comm. Ralph C. Lantion, Chairman, Committee on Security Personnel/Gun Ban, relative to the proposal to amend Sec. 6, Resolution No. 3420 (Guidelines On The Establishment Of Comelec Checkpoints In Connection With The May 14, 2001 National And Local Elections).

The Memorandum of Comm. Lantion reads:

"One of the concerns raised during the Joint COMELEC/AFP/PNP Command Conference on 15 January 2001 held at Camp Aguinaldo, Quezon City is Sec. 6 of COMELEC Resolution #3420 which pertains to Personnel to man checkpoint in connection with the May 14, 2001 National and Local Elections.

"It was proposed that said Sec. 6 be amended such that the checkpoint be led by a regular member of the AFP/PNP with a rank of SPO4 or Master Sergeant instead of a lieutenant/inspector.

Recommend the adoption of such proposal by the Commission En Banc."

Quoted hereunder is Sec. 6 of said Resolution No. 3420 which is sought to be amended:

"Sec. 6. Personnel to man checkpoint. – Any unit designated to man a Comelec checkpoint must be led by a regular member of the AFP/PNP with a rank of at least lieutenant/inspector."

Gen. Efren Fernandez of RECOM. 8 requested the amendment during the joint COMELEC/AFP/PNP Command Conference held on January 2001 because of the limited AFP/PNP personnel with a rank of Lieutenant or Inspector available to man the checkpoints throughout the country.

In view of the foregoing, the Commission RESOLVED as it hereby RESOLVES to amend Sec. 6 of Resolution No. 3420 now to read as follows:

"Sec. 6. Personnel to man checkpoint. Any unit designated to man a Comelec Checkpoint must be led by a regular member of the AFP/PNP with a rank of at least SPO4 or MASTER SERGEANT."

Let the Executive Director implement this resolution and the Education and Information Department (EID) cause the publication hereof in two (2) newspapers of general circulation.
